Working Process

Optima Tax Relief offers clients a free consultation to assess their eligibility for tax relief. Qualified taxpayers undergo a two-phase process. First, Optima Tax Relief protects clients by investigating their tax records, establishing contact with the IRS, requesting a temporary stay on collection procedures; and preparing a list of available negotiation and settlement options. The initial stage can take two to four weeks to complete. Second, Optima Tax Relief ensures taxpayers are in compliance with tax laws and mediate the best settlement available. The resolution stage can take three to nine months to complete. These include offers in compromise, installment agreements, innocent spouse relief, penalty and interest abatement, bankruptcy, expiration, as well as levy and garnishment release.

The initial consultation is free. Once Optima Tax Relief determines a taxpayer may qualify for tax relief, it charges a $995 fee to start its investigation phase. This fee comes with a 15-day money-back guarantee. Once a resolution plan is prepared, Optima Tax Relief charges a second fee that ranges from $995 to $9,995 to finish the process. Cost varies depending on the size and complexity of the case.

Offer in Compromise (OIC)

To qualify the customer must have an inability to repay the debt within the time the IRS has to collect on the debt.

Penalty Abatement

The IRS may assess a variety of penalties on customer's tax account including late filing and late payment fees. Sometimes the penalties dwarf the actual tax debt.

Installment Agreement

This agreement allows the customers to pay their full debt in equal, yet smaller and more manageable amounts.

Partial Pay Installment Agreement (PPIA)

A payment agreement whereby the total number of payments made to the IRS is less than the total amount of tax due, when full payment cannot be completed prior to the expiration of the statute of limitations.

Tax Lien Discharge

Customers relinquish their rights and allow any property with an IRS lien to be sold free and clear of the tax lien.

Tax Lien Subordination

Allows a “junior” creditor to move ahead of the IRS for claim on the property.

Tax Lien Withdrawal

Customer's tax liability is satisfied and the lien is released.

Wage Garnishment Release

Customer's liability is satisfied and the garnishment is lifted.

Bank Levy Release

Customers paid their tax debt or the time limit expired, releasing the levy.

Innocent Spouse Relief

Customer filed a joint return, the tax due is understated, customer didn’t know, so it is unfair to hold them liable.

Currently Non-Collectible

Assigned by the IRS when someone cannot pay due to a temporary hardship.

Statute of Limitations

The time limitation (generally 10 years) on which the IRS can collect taxes and levies. The start time varies for each action taken.

Collection Appeal

The Office of Appeals is separate from and independent of the IRS Collection Office.

Administrative Appeal

The customer may file an administrative appeal with the IRS under some circumstances.
